    Smoking and Possessing Tobacco Products 

    Any person who knowingly sells or gives tobacco products to minors is guilty of a petty offense.  Any minor who has tobacco in his or her possession is guilty of an incorrigible act.  (ARS 13-3622). 

    Tobacco products are defined as cigars, cigarettes, or cigarette papers, and smoking or chewing tobacco. (ARS 13-3622) So if you are under the age of 18 you should not have any of these items. If you do, you are guilty of an incorrigible act.

    In addition to this, smoking tobacco in locations such as elevators, busses, libraries, museums, and health care institutions is considered a public nuisance and dangerous to public health.  An adult guilty of such acts would be charged with a petty offense, while a minor would be charged with a delinquent act.  (ARS 36-601.01). 

    What about at school?

    Using or possessing tobacco products on school grounds (buildings, parking lots, fields, and vehicles) or at off campus school sponsored events is a petty offense for adults and a delinquent act for minors.  (ARS 36-798.03).  The law does not apply to adults using tobacco products as a part of a tobacco prevention or cessation program.  (ARS 36-798.03).

    I don't think that smoking is all that bad because i smoke and it does sometime helps, but when you start smoking its kind've hard to quit because it's something addictive... All i know is that smoking is a stress reliever and as it was told it causes cancer and it has soo many diseases that you dont know how many can kill you in an instant... Now i'm a non-smoker and i want it to be thayt way for the rest of my life, because i know and you know how hard it is to quit and so for all you youngsters never pick up smoking from any of your friends and never think that it'll help because it doesn't

    Currently, I am a smoker, and have been for 3 years. I also have done many research papers on the affects of alcohol and tabacco, as well as the laws. I have spent a lot of time in DOC (Adobe Mountain Juvinile Detention Center) as well as the FDC (Flagstaff Detention Center) Durring my time there I have read the law completely about alcohol and tabacco related laws. It is iligal for a minor to be in posetion of a Tobacco product. If a minor is found smoking by police, be sure to know your rights. After you state your name, plead the 5th.
