    Smoking and Possessing Tobacco Products 

    Any person who knowingly sells or gives tobacco products to minors is guilty of a petty offense.  Any minor who has tobacco in his or her possession is guilty of an incorrigible act.  (ARS 13-3622). 

    Tobacco products are defined as cigars, cigarettes, or cigarette papers, and smoking or chewing tobacco. (ARS 13-3622) So if you are under the age of 18 you should not have any of these items. If you do, you are guilty of an incorrigible act.

    In addition to this, smoking tobacco in locations such as elevators, busses, libraries, museums, and health care institutions is considered a public nuisance and dangerous to public health.  An adult guilty of such acts would be charged with a petty offense, while a minor would be charged with a delinquent act.  (ARS 36-601.01). 

    What about at school?

    Using or possessing tobacco products on school grounds (buildings, parking lots, fields, and vehicles) or at off campus school sponsored events is a petty offense for adults and a delinquent act for minors.  (ARS 36-798.03).  The law does not apply to adults using tobacco products as a part of a tobacco prevention or cessation program.  (ARS 36-798.03).

    i think 17yr old people should be able to smoke and no youger and if anyone else is caught they should be put into jail for a year

    I think if you work in a grocery store and are able to pick up a pack of cigarretts or even touch a can of beer you should be able to sell the products. as long as your not buyong them or using them,or selling them to minors.

    I think if you are of age then smoking should be allowed in a designated smoking area away from people who are either allergic to tobacco, or the smell bothers them. That way, teachers can relieve stress, and so can other people of age. However, I think there should be a cop to check ID's at the entrance and it should only be open b4 and after school, and during lunch.

    We are doing a project at school about smoking on campus. We are trying to find background information about why tabacco is not permitted; How the law came around to being what it is; and the details. We are trying to debate wether or not it is our right to smoke near campus, if you help that would be greatly appreciated. I will be checking back in a couple of days. Thank you for your help.
