Question: If you get really angry at someone in the middle of an argument, lose control and kill them, does that constitute murder?

Answer:

Yes, it would still be murder, but it would be considered a lower category of murder such as 2nd degree or negligent/reckless homicide since it was not planned in advance.  These lower catergories of murder carry less prison time than 1st degree murder, which could result in the death penalty.
