Question: What are the different levels of misdeameanors and felonies and how does a judge determine a level of conviction? Is it based on the cost of restitution if it is a burglary, shoplifting, etc. What about aggravated or violent crimes?
Answer: Generally misdeameanors and felonies are divided into different classes based on the severity of the crime committed. Felonies are divided from Class 1 (most severe) to Class 6 (less severe). Misdemeanors are divided from Class 1 (most severe) to Class 3 (less severe), and petty offenses are not classified. Many different factors are used to determine the level of classification for a crime depending on the crime, the value of the goods if applicable, the status of the victim, etc. as well as the level of violence used in the crime.
