Question: How soon after being arrested must I be allowed to appear before a judge?

Answer: After you are arrested and processed, you must be brought before a judge for an "initial appearance" within 24 hours.

Lynne I'm sure there is some amount of time you can be held before they are required to present charges. This is just another perk of being innocent before proven guilty. If you have an attorney he should be able to explain this. If you don’t you are going to need one, paid or otherwise. Also I suggest your husband not talk to the police without council. That was my biggest mistake back when I thought you could trust police.

I don't think this is true (or maybe not entirely true, or maybe just not true in my state) because my husband was arrested three days ago, and will not go before a judge for two more days. Then, they will tell us exactly what his charges are, and the judge will decide whether or not he gets bail and what the bail will be if he does.
