Question:

What happens if a person under the age of consent rapes a person over the age of consent? (Ex: A 12 year old rapes an 18 year old.)



Answer:

The law does not recognize the possibility of a 12 year old raping an 18 year old or older adult. The law requires that an 18 year old refuse or prevent a sexual act from occurring. Simply put, the law requires that the act be non-consensual.

Non-consensual means not wanted, or forced. So non-consensual sex is rape. And it is nonsense that a minor could rape anyone they wanted, and get away with it! That is probably the stupidest law ever made!!!!!! Whoever made that law was not thinking straight. So if a 17-year-old guy who is most likely much stronger than i am (I'm 18) rapes me, thats still statutory rape. BS
