Question: If a friend has pot and you are with him, can you be charged with possession of marijuana?

Answer: Anytime you are in the presence of someone performing an illegal act, like possession or use of marijuana, you face the possibility of being charged with the same illegal act. In Arizona, as in most states, criminal liability can be based on the conduct of another person. This is referred to generally as accomplice liability, and requires that the accomplice either aid, abet, encourage, or provide the opportunity for the other person to commit the crime.

personally i have been caught by the cops with someone who was smoking pot (marajuana) and at the time I wasnt. I had to go to court with my friend to defend myself and i was proven guilty. I was on probation for 1 year and I had to do a lot of community service. DONT make the same mistake I did.

Say if you were driving and you got pulled over the cops searched you and the vehicle. If you're friend takes it out of his pocket and tries to hide it in your vehicle then it will be charged as your weed. But if he's a true friend he wouldnt do that and it'd be charged as his weed and you'd just face the ticket for whatever you got stopped for.
