Question: Can I being charged for drug offenses & child abuse because my son had drugs on him in my house?

Answer: It depends. Assuming that your son is under the age of 18, if you supplied drugs or facilitated the use of drugs in the house, you could face charges for both possession and child abuse. Also, if you are the adult in charge of the house and knew the drugs were inside and allowed them to be there, you could be charged with constructive possession of them.

In regards to the child abuse charges, if you supplied or facilitated the possession/use of the drugs, not only could you be charged with child abuse, Child Protective Services (CPS) could remove your child(ren) from your home and you could ultimately lose him (them).
