    printer friendly version

Question: My mom filed charges against someone for sexual conduct with a minor. Now she wants to drop the charges is she allowed to do that?

Answer: No. Once a crime has been brought to the attention of law enforcement authorities (police and/or prosecutor) it is the decision (and obligation) of the authorities whether or not to proceed with the case. Your mother may not wish to be involved with the proceedings, but if the authorities need her testimony she will be subpoenaed.

Right now my boyfriend is in jail because i'm a minor, and he's 19 years old. My mom called the police a half a year ago on us but the police didnt do anything until right now. I dont think that he should be punished for something i had a part of. i'm not stupid, i knew what we were doing. He didnt rape me, it was consentual. I think the laws should be changed in that area because he didnt take advantage of me. We've been together for years.

My boyfriend is pressing charges on my 16 year old son for lude and licentious acts on a minor, his daughter who is 12 years old. I wish he would drop the charges....but the District Attorney will pick them up. His daughter was a willing participant. They say there is a 10 year mandatory sentence and they want to try him as an adult.
