    Question: I'm 9 years old. What happens to me if I'm with my dad and he is caught with marijuana?

    Answer: If you, yourself, do not have any marijuana on you (in your pockets or backpack or whatever), you will not be charged with possession of marijuana. If a witness saw you use some, you could be charged with use. Your dad will be charged with possession.

    It is never okay for adults to use or possess drugs, especially around kids. If he is your only parent, Child Protective Services (CPS) could become involved. If the people there believe he is not willing or able to parent you, or you are being abused or neglected as a result of his drug use, a dependency case could be filed. Basically, CPS would be trying to get him to clean up his act.

    Remember, you are not responsible for the actions of grown ups.

    I think it's messed up. My dad does pot and always has done it around me and somehow i am a B average student. You shouldn't be exposed to that, neither should i so you should say, "dad if you really care about me, you will not do it anymore!" then he will probably stop, or not, i told my dad that and he didn't stop. At least try it!

    It's sad to read the responses that you got for your question. Nobody seemed to answer your question. Let me try with my limited knowledge on law. I do know that if yoou are with your dad and he is arrested for possesion a family member will be contacted whether it be your mother, Aunt, Uncle, brother, sister and or cousin (if at an appropriate age will ask them to pick you up. If none of those people are available you wait until social services to pick you up and place you in a foster home until your dad goes through the steps to getting you out of there. When he is using your in bad company.
