    printer friendly version

Question: Can a cop strip search a minor?

Answer: If the circumstances would justify a strip search, there is nothing that would prohibit one just because the person being searched is a Minor. Strip searches can be justified where, for example, a person is being booked into a jail. The goal is to keep contraband (ie, drugs) from getting into the facility. Therefore jailers can strip search new inmates. A police officer cannot strip search someone without a proper reason, however. Furthermore, where strip searches are done, they are usually done by an officer of the same sex as the person being searched unless emergency issues make that impossible.

Well I would have yelled at your kid also no offense. He obviously drugs on him by now allowing them to search him. Maybe you should be more concerned about your kid and not what the cops are doing.

My son was taken out of class because a classmate was acting suspicously, the classmate said my son was the one with drugs. My son TJ, was taken to the office by the cheif of security and onsite police. TJ is a freshman. They asked him if they could search him, his answer,"I can't answer that until you contact my mom or an attorney." They asked him questions, He also replied,"I'm not answering any of your questions until I get an attorney." For MANY hours 3 grown men (officers) yelled at him searched him and continued to "grill" him. The moment he asked for an Atty. the questions were illegal.

TJ's mom again. He was taken to Juvenile Hall, stripped searched held for hours, all without my EVER being notified he was even in trouble. They found Marajuana on him as well as klonipin, the other kid said belonged to TJ.TJ did wrong & deserves to be punished. He is a leukemia survivor, for 3 1/2 years he was given drugs daily, harmful mind altering drugs. My complaint is that the Pima county Atty. wants to charge him with a class 4 felony, same as having crack or herione at school. Then the Co. ATTY. threatned if we don't take his offer they will charge TJ with a class 2 felony.MURDER is a 1.

I note that the City of New York has agreed to a $50 million settlement to compensate persons who were routinely strip searched when being booked into jail. Keep up the good advice!
