    printer friendly version

Question: What kind of crime would I have to commit to be put on house arrest?

Answer: According to Arizona Law (ARS 8-201), 'detention' means the 'temporary confinement of a juvenile who requires secure care in a physically restricting facility that is completely surrounded by a locked and physically secure barrier ....'

With this in mind, home detention, also known as house arrest, is considered an alternative to 'detention' in which case the juvenile is allowed to be released into the community and return home, but with strict requirements. Home detention greatly restricts the juveniles freedom and requires that the juvenile does not leave their home unless: 1) accompanied by a parent or guardian, and/or 2) attending school, work or counseling. Home detention can use an electronic monitor (ankle bracelet) which requires that the juvenile stays home at all times unless given permission by their probation officer.

Reasons for having home detention/house arrest ordered include but are not limited to:

    1) being placed on JIPS (Juvenile Intensive Probation) which according to ARS 8-271 is a highly structured and closely supervised juvenile probation.... which emphasizes surveillance, treatment, work, education and home detention. The Supreme court's Administrative Order No 90-9 denotes that there are two categories of juveniles who shall be placed on JIPS - 'those who would otherwise have been recommended for placement in an out-of-home institutional or residential setting,' and 'those who, through considering of the nature (type and severity) of the their offense (and) their prior delinquent history of their risk to the community, have demonstrated a need for highly structured, closely supervised program of probation.'
    2) having a history of court noncompliance (including failure to appear for court appointment and/or hearings)
    3) having previously had a warrant issued for your arrest
    4) having a history of absconding (running away)
    5) if the probation department feels that you are likely to commit an offense injurious to (yourself) or others'
    6) based on the nature (type and severity) of the offense
    7) if you commit a crimes against a person (assault, burglary, etc) or animals (cruelty)

No, its not a joke, one of my good freinds is on house arrest and he has to complete a 10 month time period in Eckards (a wilderness camp) maybe you should check in next time you think about hurting someone or damaging propertie(s). You are probaly just spoiled, or joking around becuase the law DON'T play around, but just becuase you or your parents dont think you need punishment means you probaly do and im not sorry for you because you need to be punished if you or anyone is doing illegal distruction.
