    Question: Is it legal for a campus police officer to give a 13 year old a breathalyzer without contacting a parent first?

    Answer: Yes, an officer can legally give a sobriety test to a 13 year old student without contacting a parent first. Most officers would contact parents first, but it is not a legal requirement.

    If the state the 13 year old lives in has a minor zero tolerance law, and the police officer believes the minor has been consuming alcoholic beverage, no parental permission is needed. The teen must comply with the officer or be reprimanded to the juvenile authorities. Parents or not.

    What you say to the cop, if your parents dont care you drink, is that you were at home drinking with you mom and dad and you friends came by and picked you up. As long as your not driving. Their is always ways to get out of tickets. But cops think they are the coolest and they can do whatever they want so get and fold up wallet size bill of rights and just look in it whenever you get in trouble.     If it is legal for the breathalyzer to be given, then the next question would be, can the kid say no? It would seem to me that it would be next to impossible for them to make the kid do it. After all, it's not like they can take away his/her drivers liscence......
