    Question:

    What is a juvenile in possession of tobacco products guilty of?



    Answer:

    Any minor who has tobacco products in their possession is additionally guilty of an incorrigible act.(A.R.S. § 13-3622). Using or possessing tobacco products on school grounds (buildings, parking lots, fields, and vehicles) or at off-campus school sponsored events is a petty offense (delinquent act for minors). The law does not apply to adults using tobacco products as a part of a tobacco prevention or cessation program.(A.R.S. § 36-798.03). Smoking tobacco in locations such as elevators, busses, libraries, museums, and health care institutions is considered a public nuisance and dangerous to public health and is a petty offense (delinquent act for minors). (A.R.S. § 36-601.01). Punishment for delinquent or incorrigible acts may include community service, counseling, education programs, fines, probation and detention (juvenile jail). A.R.S. § 8-321 and 8-341)

    I got arrested today for possesion of cigarettes got a ticket and my 2 packs of cigarettes takin. also I was ditching school so I got suspended for 2 days and sent to a tobbaco program at another high school even though I wasn't on campus...thats California laws for you they cant charge you more than once so they charge you 3 different ways....

    I work at a public school system and we have a HUGE problem with students smoking. We try to write them up and we are told we can't because the student threw the cigarette down and did not have it in his/her hand. Our hands are totally tied when it comes to dealing with this problem and I think the law needs to state "as long as the student is suspected of using tobacco (which we know is happening because we have a closed campus and they get out during class breaks) we have the right to punish according to our student handbook".
