    Question: If someone puts an illegal weapon/narcotic on you without your knowledge, can you be arrested and prosecuted?

    Answer: Yes, if an illegal weapon or narcotic is found on you, you can be arrested and prosecuted. The fact that someone placed these on you without you knowing would be a defense to the charges. Usually the crime of possession of a narcotic or possession of a weapon requires that the person knowingly possessed these. If you did not know you possessed the weapon or narcotic, this part of the crime might not be proven. In reality, it is very difficult to prove that you didn't know something illegal was in your possession unless the person who placed it there was caught on tape or confesses.
