printer friendly version
Question: Does maliciously dumping beer on someone's head constitute assault or some other violation of the law?
Answer: Yes, if the person pouring the beer did it on order to hurt the other person, insult him/her or try to start a fight. A.R.S. section 13-1203 is the statute that explains what an assault is and A.R.S. 13-1203(A) (3) is the specific part of the law that applies to your question. Throwing a substance at another person is considered -touching- under this section of the law. See answer to question 5 under -violence- section of Speak Up to learn the punishment for assault.

What happens if you "accidently tripped" and the other person says it was malicious cause they hate you? How does one tell if it was malicious or not and if its their word against yours?

I think that there shouldn't be a law against carrying at least a kendo stick. Because I practice kendo and being hit doesn't hurt. But I guess the government found those reasons on it.

Sneezing on someone is a SOCIAL no-no, no a CRIMINAL offense. If, however, the person sneezing has a potentially deadly, communicable disease, His intent would be the only thing that might get him off criminal charges. i.e. Was he intending to annoy or to transmit the disease?
