Question: Is it considered rape if you are passed out and someone has sex with you when you dont know?
Answer: Yes. You have to consent to sex, and if you are passed out you don't have the ability to say "yes".

Depending upon why the person is passed out it can also determine the sentence for the offender. If the offender slipped the other person a date rape drug it can be considered an additional crime
