Question:

if you are in a store with a friend, and your friend steals a shirt, but you don't, can you be charged with shoplifting?



Answer:

Yes, if the police believe that your friend acted with your intentional assistance (as a look-out, distraction, or at your direction/advise/solictation, etc.), it is possible that you could be charged under the theory of accomplice liabilty (Aiding and abetting). Also, it is possible to be convicted as an accomplice even if the person who actually did the shoplifting is not convicted.
