Question: Does a minor that is detained for underage consumption have the same miranda rights as adults?

Answer: Absolutely! A minor is entitled to Miranda warnings when they are being detained AND questioned by the police. A minor DOES NOT need to admit crimes to a police officer just the same way an adult does not have to giving damaging statements about themselves.

My brother was ticketed for consumption of alcohol by minor and taken to police station without handcuffs, is that still considered being arrested? If it is considered being arrested shouldn't he have had his miranda rights read?

I was given a DUI and underage consumption but i got both charges dropped. About 1 week after i got the case dropped i got another underage consumption. The cop put me in the car, did not tell me my rigths,, called me all kinds of names,and didnt give me a breathalyzer.How does he know that I didn't take jsut a little drink of beer and it was on my breath? That was the only reason he gave it to me was because of the smell. Somebody tell me what I should do or what you think might happen to me.

I was arrested twice for underage consumption and i was never read my miranda rights, but I was for my dui arrest. When I told the court clerk that I was never read my rights she said that the police didn't have to on underage consumption arrests. Why's that?
