Question: What is the punishment of an adult found guilty of consensual sex w/a 15 year old and charged with a class 6 felony?
Answer: It really depends upon what the offense is specifically charged as. This answer assumes it has been charged as sexual conduct with a minor (A.R.S. § 13-1405(B)). If it is a simple class 6 felony, the range of sentencing is 6 months to 1.5 years. Arizona law (A.R.S. § 13-702.01) allows for the prison time to be decreased to 4 months or increased up to 2 years. Probation (up to 3 years) would also be available.
The person also has to register as a sex offender under Arizona law (A.R.S. § 13-3821) if they have pled guilty to the charge or were found guilty at trial. This means in some cases that their community will be notified of the fact that they are a convicted sex offender.
