Question: What is the penalty for assault and battery?

Answer: The laws are different in every state, but are basically a crime. Punishment usually depends on how serious it was, if a weapon was involved, was the victim physically injured, etc. In many states a juvenile accused of assault can (or must) be tried as an adult. Penalties include jail, prison, probation, fines, restitution, community service and counseling. The Judge considers the age of the person, their record and the seriousness of the crime.

A girl at school was running her mouth about me and my friends and she had her cousin threaten me. I punched her, her mom overreacted and took her to the hospital saying her head hit off the wall giving her a knot and that she has a black eye. I got three days suspension from school now they are filing assualt charges against me. This is first offence, what can happen?

My stepson (14) and I had an altercation last night - it began with him being antagonistic and verbally abusive his mother and me and then throwing things, then he threated to leave - I followed him through the garage and tried to stop him (grabbed his shoulder) - he bumped his head and then swung around and took a swing at me - I grabbed him and put him on the floor and told him not to do it again. This is first time I have touched him - honestly. What can I do? His violent behavior can not continue.

You folks need to learn to quit being so ready to fight and learn to solve your problems instead of making them worse. What you don't understand at your age is that fighting is serious and could result in far worse than just going to court for a hand slap. Consider that if you hit someone and they fell and hit their head and died you would be up for manslaughter or murder and most likely go to prison for a long time. Or if you hit someone and maimed them for life (like the girl with the bat) and they were a vegetable until they died, you would go to prison, regardless of your age.
