Question: What happens if someone over 18 hits a minor (someone under 18)?

Answer:

Depending upon the nature and severity of the violence, you could be charged with various assault-type charges, for example, endangerment (A.R.S. § 13-1201), threatening or intimidating (A.R.S. § 13-1202), assault (A.R.S. § 13-1203), aggravated assault (A.R.S. § 13-1204).

 

Endangerment is a class 6 felony if it involves a substantial risk of imminent death, otherwise, it is a class 1 misdemeanor. Threatening and intimidating can be either a class 1 misdemeanor or a class 4 felony. Assault can be from a class 3 to a class 1 misdemeanor. Aggravated assault can be from a class 3 to a class 6 felony. However, if the victim is under 15 years of age, it is a class 2 felony.

The penalties for dangerous crimes against minors are greatly enhanced. For example, the penalty for aggravated assault against a minor is 17 years!

last wednesday my little brother was beaten by a 36 year old man. the man has 3 counts of aggravated assault against a minor against him he also violated his parole. what would his penalty be?

My question is this: If a minor attacks a person over the age of 18, and the adult defends themself, will that adult be doing something illegal? I mean, even though it's a minor, the young person is still creating fear and danger toward the adult.
