Question: Could you get into trouble for stalking someone?

Answer: Absolutely. Stalking is a criminal offense according to Arizona Law (ARS 13-2923).

Stalking is when,

'A person commits stalking if the person intentionally or knowingly engages in conduct that is directed towards another person and (1) that conduct would cause the person to fear for his/her safety or the safety of an immediate family member, or (2) that conduct would cause the person to fear physical injury or death of him/herself or of an immediate family member.'

A conviction under section (1) is a class 5 felony. A class 5 felony is punishable by .5 years to 2.5 years in prison and probation is available if the defendant has not been previously convicted of a felony.

A conviction under section (2) is a class 3 felony. A class 3 felony is punishable by 2 years to 8.75 years in prison and probation is available if the defendant has not been previously convicted of a felony.

A fine of up to $150,000 can be imposed on any felony offense.
