Question: What is the difference between a DUI and a DWI?
Answer: Nothing. Some states refer to the crime of driving under the influence of intoxicating
liquor (DUI) as driving while intoxicated (DWI). It is essentially the same offense,
although penalties may differ from state to state.
In Arizona, it is called DUI and a first offense is a class 1 misdemeanor in
which the defendant must serve at least 10 days in jail (which can be reduced
to 24 hours if an alcohol screening program is completed) and pay a fine of
at least $250. A second DUI committed within 5 years of the first is punishable
by no less than 90 days in jail and a $500 fine. The third offense is a felony,
punishable by no less than 4 months in prison.

I don't understand if they are the same thing then why is it some people get a ticket for a DUI and then some other people get it for a DWI if they are the same thing then I think they should have only 1 name for it but different levels.

I am a Vehicular Crimes Unit sergeant with an Arizona police agency. Let me help you understand the DUI law a little better. We don't call it DWI in Arizona, we call it DUI. If your blood alcohol level is less than .05, you are presumed by law to be unimpaired by alcohol. (Not intoxicated) If your blood alcohol is .05 to .0799, there is no presumtion. (The police have to prove you were "impaired to the slightest degree" based on your physical tests, appearance, speech, BA, etc.) If your BA is .08 or more, Arizona law says you are impaired by alcohol regardless of any other considerations.

0.8% alcohol BAC (Blood Alcohol Content) if i am wrong tell me and all the other kids out there because drunks are killing us and our neighbors
