Terms of Use Statement

The Arizona Foundation for Legal Services and Education (“AZFLSE”) presents the information on this web site as a service to legal consumers, our members and other Internet users. While this site does provide information on law-related topics, it does not provide legal advice. Moreover, due to the rapidly changing nature of the law and our reliance on information provided by outside sources, we make no warranty or guarantee concerning the accuracy or reliability of the content at this site or at other sites to which we link.

1. Agreement to Terms

AZFLSE, including its LawForKids.org project, provides access and use of this site ("Site") subject to your agreement to the following "Terms of Use" (the "Terms"). Please read these Terms carefully before accessing or using the Site. By accessing or using the Site, you agree to be bound by these Terms. 
The Terms, as well as the Site (and information contained within the Site) may be updated or revised from time to time without notice to you. You agree to periodically review these Terms, and your continued access to or use of the Site shall constitute your acceptance of the updated or revised Terms.

2. Privacy and Contact Information

If asked to provide your e-mail address during your use of the site, please provide an accurate and complete e-mail address. AZFLSE recognizes the need to protect the privacy of users of this Site, and to provide additional privacy protection to children. Children 12 years old and younger may visit this Site without disclosing any personally identifiable information. Please see our Privacy Statement for additional privacy information.

3. Use of Information and Services.

Third parties may provide certain information displayed on the Site. Although AZFLSE believes that such information comes from trustworthy sources, the third-party information is not necessarily sponsored, endorsed, recommended, or licensed by AZFLSE. You should directly contact the third parties and/or their references for the most accurate information.

4. Advice.

Neither AZFLSE nor its information sources or users are engaged in giving legal, medical, counseling or other professional services or advice in this Site. Except as described otherwise, all content in this Site is made available only to provide information.

5. No Liability.

Under no circumstances will AZFLSE be liable for any consequence relating directly or indirectly to any action or inaction you take based on the information, services or other material on the Site. While AZFLSE will attempt to keep its Site current, accurate, and complete, AZFLSE and its suppliers cannot guarantee, and will not be responsible for any damage or loss related to, the timeliness, accuracy, or completeness of the information, services, or other material on the Site.

6. Site Conduct.

When using the Site, you agree to abide by the following rules: (a) you may not post or transmit content (information, data, text, software, graphics, sound, photographs, video, messages, etc.) ("Content") that is unlawful, harassing, libelous, defamatory, obscene, fraudulent, harmful, threatening, abusive, hateful, that violates the property rights of others (including without limitation infringing use of a copyright or trademark), that violates the privacy or publicity right of others, or are otherwise objectionable; (b) you may not interfere with other users' use of the Site; (c) you may not use the Site to conduct any activity that is illegal or that violates the rights of others; (d) you may not use the Site to advertise or sell products or services to others; (e) you may not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; (f) you may not post or transmit Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, confidential information, etc.); (g) you may not post Content to the Site unless the Content is freely owned by you or used with the permission of all other persons with any rights in the Content; and (h) you may not use the Site to collect or store personal data about other users.

7. Removal of Content. 

AZFLSE does not do a prior review of Content posted by any party other than AZFLSE and has no responsibility for Content posted by any party other than AZFLSE to the Site. However, AZFLSE reserves the right in its sole discretion to delete any Content submitted to or appearing on the Site. Message boards, "chat rooms" and/or other information sharing locations on the Site may contain the opinions and views of other users. AZFLSE is not responsible for the accuracy of any messages or postings on the Site. 8. Submission of Content.

If you submit Content to the Site, you grant AZFLSE, or warrant that the owner of such Content has expressly granted to AZFLSE, a world-wide, royalty-free, perpetual, irrevocable, transferable, non-exclusive and fully sub licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) and/or to incorporate such Content in other works in any form, media, or technology now known or later developed. 

9. Internet Links.

The Site may provide, or third parties may provide, links to other Internet sites. AZFLSE has no control over such sites; AZFLSE does not endorse, and is not responsible for, any such sites or the information, material, products or services contained on or accessible through those sites. You acknowledge that AZFLSE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance upon any such information, material, products, or services. 

10. Third Parties.

Your correspondence or business transactions with, or participation in promotions of, third parties found on, or e-commerce through, the Site and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that AZFLSE shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such transactions or as the result of the presence of such third parties on the Site. 

11. Indemnification.

You agree to indemnify, defend and hold harmless AZFLSE, its affiliates, governing board, officers, agents, employees, partners, and suppliers from any liability, loss, claim, demand, and expense (including reasonable attorneys' fees) related to (a) your use of the Site; (b) your violation of these Terms; or (c) your posting of Content to the Site. 

12. Modifications to Site and Terms of Use.

AZFLSE reserves the right to, from time to time, discontinue, temporarily or permanently, with or without notice, the information, services, products, and/or other Content on the Site, or to add additional Content or Terms of Use. You should visit this page from time to time to review the most current Terms of Use to which you are bound. AZFLSE makes no commitment to update the Content or services at this Site.

13. Use and Storage of Content on the Site

AZFLSE may establish general practices and limits concerning the use of the Site, including without limitation, the maximum number of days that Content will be available on, or retained by, the Site. AZFLSE, in its sole discretion, reserves the right to change these general practices and limits at any time.

"Arizona Foundation for Legal Services and Education" and "LawForKids.org" are trademarks of AZFLSE. All Marks, content, or other materials contained in this Site are protected as copyrights, trade dress, trademarks and/or other intellectual properties owned by AZFLSE or by other parties that have licensed their material to AZFLSE. AZFLSE's trademarks may be used publicly only with written permission from AZFLSE. No AZFLSE trademark or service mark may be included in a hyperlink without AZFLSE's written permission. Any unauthorized use of the Marks or content of this Site may violate copyright, trademark, and other laws, in addition to being a material breach of the Terms of Use.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THIS SITE, AND ALL INFORMATION AND CONTENT ON THE SITE, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. IN NO EVENT SHALL AZFLSE OR ITS AFFILIATES, GOVERNING BOARD, OFFICERS, AGENTS, EMPLOYEES, PARTNERS OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, BUSINESS, DATA OR PROFITS, LITIGATION AND THE LIKE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 17. Termination.

AZFLSE may, in its sole discretion, with or without notice, suspend or terminate your use of this Site, and remove and discard any Content on the Site, for any reason, including, without limitation if you violate these Terms. AZFLSE may also bar you from any future access to the Site. AZFLSE will not be liable to you for any such suspension, termination or prohibition on future access.

Should you object to any subsequent modifications of the terms and conditions of these Terms, your sole recourse will be to immediately notify AZFLSE of your termination of these Terms, which termination will be effective immediately. To the extent permitted by applicable law, the terms and conditions of these Terms will survive any termination of these Terms.

Any notices to you by AZFLSE may be made by either e-mail or regular mail.

21. General Provisions.

These Terms constitute the entire agreement between you and AZFLSE and govern your use of the Site, superseding any prior agreements between you and AZFLSE regarding the Site (including, but not limited to, any prior versions of these Terms).

Any failure to enforce any part of these Terms of Use shall not constitute a waiver of any of AZFLSE's rights under these Terms of Use, whether for past or future actions of any person. Neither the receipt of any funds by AZFLSE nor the reliance of any person on AZFLSE's actions shall be deemed to constitute a waiver of any part of these Terms of Use. Legal waiver may be effected only by an express written waiver signed by an authorized representative of AZFLSE.

These Terms and the resolution of any dispute related to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to any principles of conflicts of law. AZFLSE's failure to insist upon strict enforcement of any provision of these Terms shall not be construed as a waiver of any provision or right. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will be enforced in accordance with their terms. The section headings in these Terms are for convenience only and have no legal or contractual effect.

Regardless of any statute or law to the contrary, you hereby waive your right to bring any claim against AZFLSE more than 1 year after such claim first arose. 

22. Arbitration.

Any controversy or claim arising out of or relating to these Terms will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party. You consent to the arbitration being conducted in the county of Maricopa, Arizona. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. Either you AZFLSE may seek any interim or preliminary equitable relief from a court of competent jurisdiction in the county of Maricopa, Arizona, necessary to protect the rights or property of you or AZFLSE pending the completion of arbitration. 

23. Acceptance of Terms.

You acknowledge that you have read and agree to be bound by these Terms of Use and to comply with all applicable laws and regulations. This privacy statement discloses the privacy practices for LawForKids.org, a project of the Arizona Foundation for Legal Services and Education (“AZFLSE”).

Information Collection and Use

LawForKids.org is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. LawForKids.org collects information from our users at several different points on our Web site. Any personal information gathered is voluntarily submitted and will only be disclosed with prior individual consent. For example, we may ask to use the first name and the name of the school attended by the student selected as "Youth Citizen." At any time you may request to delete any or all information we have retained from this website by sending an email to This email address is being protected from spambots. Registration

In order to use some features of this Web site, a user may first be required to complete a registration form. During such registration a user is required to give his or her contact information (name and email address). This information is used to contact the user about the topics on our site for which he or she has expressed interest and for the user to receive a lost password. Demographic information, such as mailing address, position, technical skill, etc., may be provided at the user’s option.

Privacy of Children

AZFLSE is committed to protecting the online privacy of children and making the Internet safe for all of our visitors. For this reason, AZFLSE does not collect personal information from children under 13. We encourage parents of children under 13 to regularly check and monitor their children's use of e-mail and other activities online and to consider using parental control tools available from online service providers and software manufacturers. These tools may be used to prevent children from disclosing their name, address, and other personal information online.

Cookies

LawForKids.org uses cookies to remember if a user has previously logged in while he/she is on our site. This allows LawForKids.org users to avoid logging in multiple times, thereby saving time. Users have the option of disabling or not accepting cookies by changing the preferences on their browsers*. If a user opts not to enable cookies, he/she will still be able to use our Web site, however, he/she might not be able to use the areas of the site that require cookies. No personally identifiable information (email address, name, etc.) is collected with the cookies that we set, and accepting cookies while on the LawForKids.org site will not put the user at risk for marketing to other sites.

*Different browsers provide different cookie-settings. With Netscape you can ask the browser to allow, warn you, or completely disable cookies. Internet Explorer has an additional feature where you can specify different settings for different security zones. You can choose to allow Web sites to create cookies for you in your "trusted sites" (like LawForKids.org), to warn you before you create them in your local Intranet zone, and to give you an option to never allow them in a "restricted zone." See the "Help" section of your particular browser for more information on working with cookies.

Web Statistics

We use IP addresses to analyze trends, administer the site, track user movement, and gather broad demographic information for aggregate use for reporting and sponsorship purposes. IP addresses are not linked to personally identifiable information. Information from our visitors is collected via web access logs, scripting languages, email, and html forms. Information collected may include log generated statistics and computer configuration, such as your operating system type, browser type, etc. Information collected is used for reporting statistics, business improvement, account maintenance, and web site improvement.

Sharing

We reserve the right share aggregated demographic information with our partners, sponsors, and donors. This information is not linked to any personal information that can identify any individual person. We share this information so that we can demonstrate site activity to secure funding to continue providing this site free of charge.

AZFLSE reserves the right to use or disclose any information with your permission or in special circumstances, such as when such disclosure is believed to be necessary to comply the law or regulations, to protect the integrity of the Site, to fulfill your requests, to cooperate in any law enforcement investigation or an investigation on a matter of public safety, or to respond to claims that any files or data violate the rights of third parties, or protect the rights, property, or personal safety of AZFLSE, its users, or the public. For example, AZFLSE will make such disclosures necessary under the reporting procedures of the Digital Millennium Copyright Act.

This Web site takes every precaution to protect our users' stored information, and we have security measures in place to protect the loss, misuse, and alteration of the information under our control.

LawForKids.org Newsletter

If a user wishes to subscribe to our email newsletter, we ask for an email address only. We do not require names or other personal information. However, the user may choose to provide optional demographic information (name, mailing address, position, technical skill, etc.) while signing up for the email newsletter.

Surveys

From time-to-time our site may request information from users via Web surveys. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include demographic information (such as zip code, age level), but no information that can identify any individual person will be collected. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.

Send This to a Friend

If a user elects to use our "Send this to a friend" function, we ask them for the friend's name and email address. LawForKids.org will send the friend a one-time email inviting them to visit the site after the request is reviewed and deemed appropriate. LawForKids.org stores this information temporarily for the sole purpose of reviewing submissions for appropriateness and sending one-time emails.

Updates

We may also send the user site and service announcement updates. Members are not able to unsubscribe from service announcements, which contain important information about the service. We communicate with users to provide requested services and in regards to issues relating to their account via email or phone.

Correction/Updating Personal Information

If a user's personally identifiable information changes (such as zip code or email address), or if a user no longer desires our service, we will endeavor to provide a way to correct, update, or remove that user's personal data provided to us. Users can use the "Edit My Profile" link from the LawForKids.org homepage or they can email our Help Desk (This email address is being protected from spambots. Choice/Opt-in

Our users may be given the opportunity to "opt-in" to newsletters and site update emails. For example, our LawForKids.org Update form has checkboxes that let users choose which topic(s) they would like to receive email updates on. Likewise, LawForKids.org Update is an "opt-in" newsletter. To unsubscribe from the LawForKids.org Update, please see that section above. To unsubscribe from any updates, users can use the "edit my profile" link from the LawForKids.org homepage. To avoid receiving certain topic updates, the user can simply deselect the topics, and hit the "modify" button.

Notification of Changes

If we decide to change our privacy policy, we will post those changes on our home page so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, that we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

Acceptance of Privacy Terms and Conditions

Your access to and use of this Site is subject to these privacy terms, to the current Terms of Use available on this Site, and to all applicable laws. Such access and use indicates that you fully accept, without reservation, these terms and conditions.
