Question: Can the father of my baby get custody of our baby if he is going to be tried for sexual misconduct with a minor? He is 27 I am 14.

Answer: This question depends a great deal upon the state from which you write and the facts of the case. However, in general he will not be able to get custody in the very near future. If he goes to jail, and given your age and his, it seems that he will, he will not be in a position for awhile to ask for custody. Usually custody decisions are based on what is in the best interests of the child. If you can provide for the child it may live with you, although custody would be given to a legal adult. When you become a legal adult, if you are able to provide for the child, then you would have custody. However, if you are not, and the father gets out of jail, he could ask for custody if his parental rights were not terminated because of the criminal matter. I'm sorry, but you will just have to ride this one through. There is no way to predict. Good luck to you and to your child.

I know that I do not know the details of your situation, however, you can allow your child to see the father with or without visitations (once it is legally ok....probations etc) however, I would NOT....I REPEAT...DO NOT voluntarily give another person joint custody. With joint custody, only one parent gets actual "primary residense" of the child, and the joint custody is mainly for visitaion purposes.
