Question: When the law attempts to arrest someone for not paying child support, and this person runs from the law what would the punishment be for this crime?

Answer: Usually for simple non payment of child support, a person will not be arrested. He will have his or her wages garnished if he or she is working. He will have any income tax return intercepted and sent to pay child support. He can have his drivers' license suspended.

For a simple case of owing money, we do not generally put people in jail in this country. If a person is in prison or jail, he cannot earn money to pay the debt.

A parent has a duty to support his or her child. With some exceptions, a parent who knowingly fails to furnish reasonable support for the parent's child is guilty of a class 6 felony. (A.R.S. § 25-511)

I have a warrant for my arrest because i have not payed support.i have a disabled child,i cant get any childcare for him therefore i cant work,i have another child i have to raise as well.we are barely making it on disability.if i turn myself in who will take care of my kids?heres the best part,the child does not live with the other parent (courts dont know) i think i have been treated very unfairly...

Be very careful on this topic. When the money was garnished and taken away from my ex-husband's taxes he threatened our lives, he broke into our home but we were not home at the time, years of stalking and hang-up phone calls at my parents' home, ect. We have lived in hiding for over twelve years, moving all the time. Nothing he would do would surprise me. There is always a very ugly side to forcing somebody to do something against his or her will or face jail...like killing the problem! He now uses his dead father's identity. It's very scary!

I am surprised to read all the comments against the payment of child support. To all the women who responded by saying how hard things are because their husbands have to pay so much for their children from a previous relationship, was this not a problem before you decided to have children of your own with him? If it was, maybe you should have thought twice about having children with him you knew you wouldn't be able to afford. A person's (man or woman) obligations in life come to them one at a time and your husbands obligations are to his children from his previous relationship first.
