Question: I live with my mom and I want to live with my dad because me and my mom don't get along. My mom says that she won't let me go live with him. I don't want to stay with my mom, is there a law saying that if my dad takes me, he'll be charged with kidnapping?
Answer: If your mother has legal custody of you and your father takes you from her, he could be charged with custodial interference, a class 6 felony. If your father takes you out of state, he could be facing a class 4 felony. Your father must request a change of physical custody through the court, which may or may not be granted, depending on the circumstances of the case.
In any case, taking you from your mother without first obtaining the court's permission is not the solution. You might consider speaking with your school counselor about the problems you are having with your mother, maybe the counselor could help both you and your mom learn to get along better.

i live w/ my mom and my mom and i DONT get along AT ALL. we are totally difernt and dont see anything eye to eye. iv asked her if i can live w/ my dad but she alwasys says no because she thinks that just becuz shes my mother and that her house is a little nicer then my dads i have to live w/ her its SOO annoying

You are lucky I cry myself sick at my moms my dad says that hes gunna try and get custody I talk to consulers and docters and they talk to jusdges who will give custody to my dad if they get enough information from the doctors and stuff :)

But now shes all demanding that i must live with her and that i have no choice. Shes making me not see my dad for the rest of the summer and shes like kidnaping me in a way, even though shes my mom. Me and my dad get along very well and i have a life down where my dad lives. I have a boyfriend that i really love. I dont know wut to do???

OK...i live with my but we really do not get along...it has come to the point were i just take her as a joke.....i really want to move with my dad because i respect him and i know i will be much happier with him..my grades have even gone down so low its embarrassing..IM SO STRESSED!!! I live with my mom almost my whole life till one day she kicked me out. i went to go live with my grandma unable to dell with how my mom treated me over the years and verbal abuse i had a breakdown . i went to the hospital i was there for 5 days i was force to go live with my mom.since then its been really hard she treats me so bad that i want to go live with my dad.but when i tell my mom that i want to move with him she threated me by putting a resetraing order against my grandma and she says that she will call the cops on me how can i move with my dad ASAP
