Question: My father wants to give up his parental rights, can he do that, and can my mom still get child support from him?

Answer: A father cannot give up his parental rights all by himself. He has a duty to support and to "parent" his child. He can agree to allow someone else to adopt his child if that person is willing to do so. He can lose his parental rights if he does certain things, i.e. neglects the child, abandons it, is unable to parent the child because he is mentally ill or in prison for a very long time, etc.

If a person adopts the child, or if his rights are terminated, the parent no longer is responsible for current child support. He would still have to pay back child support, which is child support he was supposed to pay for the months before the termination.

My husband has a daughter from a previous marriage where she has specifically asked him to give up his rights and said she would waive current and back support. She said it was in the childs best interest yet she also asked him if he would be willing to still carry her health insurance on her and when he said he wouldnt' be able to she changed her mind. Since weve been together he has always had to fight w/her to see his daughter and it has been a source of stress. it just frustrates me when the dad is trying to do the right thing and the mom is evil and is out to get anything she can.

I have a 16 year old daughter that has never know her father! He was orderd to pay support in 2001 (when she was 8 years old) To this day I have rec'd less that $500 her entire life. I don't understand why a woman would say that they don't want the child support... even if you don't need it- put it away for your child!!! They can use it for college, their first car, or something that they really need! Just because you want to say "I did it all on my own" doesn't mean that your child doesn't deserve it! Child support is a rough situation and even though I do ok- I still beleive in support!

I agree with some of the comment, both supposed to have equal right. If the mother never allow a good father (good here, pay child support, life straight, no abuse history ) to see the kid at all then let the father's parental right terminated. Honestly..I have a friend who is saving the money from child support to rich her self...daughter ?? grandma takes care of her whenever she is on the cruise, or party...on the other hand man should be responsible for child support if he knows that the mother take good care of the child, she let him see his child, even though no more love between them
