Question: My father wants to give up his parental rights, can he do that, and can my mom still get child support from him?

Answer: A father cannot give up his parental rights all by himself. He has a duty to support and to "parent" his child. He can agree to allow someone else to adopt his child if that person is willing to do so. He can lose his parental rights if he does certain things, i.e. neglects the child, abandons it, is unable to parent the child because he is mentally ill or in prison for a very long time, etc.

If a person adopts the child, or if his rights are terminated, the parent no longer is responsible for current child support. He would still have to pay back child support, which is child support he was supposed to pay for the months before the termination.

I totally agree with Sheila I had my first child at 17 and his dad wanted nothing to do with him so I didnt force him to I never went after child support Because I choose to have him and I need no man to help take care of my child So I do think men get the raw end of the deal us as ladies can decide to abord with out the dads concent so why is it that thay are forced to pay child support if you have any doubt that he is not going to be there then why would you get pregnant anyway my advice keep your legs closed or take care of your baby yourself...

I'm going through a similar situation to some of yours. I am 6 months pregnant and the "father" has said he was going to give up all rights to my child and doesn't want to see him. I'm not sure of he will really do so, but I still want child support from him. He has four other children and three step kids!! I didn't know this when I got pregnant. He also has a girlfriend of a year and a half. His youngest child is 4 months old.

Shelia from Ohio, I feel your statement is very sexes. Granted both parties should be taking the necessary steps to prevent conception if not wanted but sometimes things happen. How you ever been faced with a decision to have a child or not? Do you have kids? Do you know what is said to you at an abortion clinic? If you answer yes to any of these questions then you know the hurt, turmoil and pain a woman goes through when faced with this decision. It is not fair that it took two party to create a child and only one actually end up caring for it. Mens right what about the child.

I think it is absolutely ridiculous that a woman can make a choice to have a child or not, i know it is not a easy decision, but why is a man just supposed to take care of a child that he didn't want, but women can have an abortion or give a child up for adoption, or drop it off at a church if she doesn't want iti know that both parties are supposed to be responsible on the issue of birth control but i really believe men are getting 'their rights ignored'
