Question: I am being charged with credit card fraud but have no record, is it possible to get probation?

Answer: Yes. Most often, first time criminal offenders are placed on probation for their crime. The exceptions to this are crimes that involve the death or serious physical injury of the victim or crimes in which the defendant used a weapon, such as a gun or knife. Credit card fraud does not fall under these exceptions and typically, the prosecutor will offer a plea agreement that will place the defendant on probation. Even if the defendant is convicted at trial, however, the judge is likely to place a defendant on probation if he does not have any prior criminal record.

I was recently charged with felony because I used someone else's credit card. I myself told the police that I had used it because I could not live with the guilt inside me of the crime I had commited. The police has told me that they have spoken to the prosecutor and he is not looking for any jail time. I just want to make sure if there is any jail time involved for first time offenders. I am 22 years old and have had a clean record in the past. I spent $400 on the credit card. I live in Vancouver, Canada. I have been charged with using another persons credit card. I did not know that it was stolen. I will be pleading not-guilty. I will be defending my self. If any one can help me find information on this subject so I know what to anticipate and what I can use to properly defend my self it would be greatly appreciated.
