Question: Is it legal for a school to expel a student if they find out he is gay? Is it legal for a school to take a way privileges from anyone based on their sexuality? Is there anything you can do about students teasing other students about their sexuality?

Answer: A federal law called Title IX prohibits schools that receive federal funds from discriminating against students on the basis of their sex, including their sexual preference. So, if your school is a public school or even a private school that accepts federal support, the school cannot expel or withhold a privilege because the student is gay or lesbian. A public school student who is sexually harassed should report the problem to the school principal. If nothing is done, a complaint can be filed with the Office of Civil Rights of the U.S. Department of Education. Further information is available at the US Department of Education Website. These restrictions do not apply to a private school operated by a church or religious denomination.

I have been expelled from school for 10 day because I was harassed by another student. I went to a higher official on this issue in my school but no documentation was made. She was not only harassing me in school but after school extracurricular activies. My mom was told that it was not going on in school therefore they couldn't do anything about it. On Sept. 4 during breakfast this girl was yelling profanity at me and threating me, of course there was no adults in the lunch room to supervise. She threw a fork at me but missed than she got up and jumped over the table and grabbed my hair
