    Laws - View Law: TRUANCY

(not being in school when you are supposed to be)

It is against the law for anyone between the ages of six and sixteen to not attend school. However, there are some exceptions through excused absences, home school, etc. Even if you miss just one class period without an excuse, you are considered truant.

If you miss school a lot (5 days, unexcused) you are considered to be habitually truant (ARS 15-803).  An attendance officer can enforce this law. The officer can give you a ticket requiring you and a parent to appear before an official of the court. (ARS 15-805)  If you are habitually truant you could be put on probation, have your driver’s license taken away, or have to attend counseling or educational classes. (ARS 8-323)

To open a few eyes, if you are parent/guardian cited for a child's truancy you face a possible 5 days in jail, 1 yr probation, $300 fine, and parenting classes. I should know because I have a bench trial pending in Phoenix City Court.

It is frustrating because it is not enforced at my school. I wonder if they even know the law exists. I am a teacher and I try and tell my kids they are ruining their future and increasing their risk of dropping out altogether but I wonder if they even care?

Heres one for AZ. I have a kiddo with numerous medical difficulties, on meds ect. We (notice I say we not he)has had 20+ excused for medical but has been from 1 to 8 minutes late in the morning about a dozen times. Their "mediation" consisted of 4 goals of which were reasonable. However one part read " or bring to the school nurse to be checked. They argued with me that these were seperate and not related issues (medical vs school tardiness. I wanted nurse removed and they refused saying it was manditory, I had no rights at this point and see ya in court.

i think that this law is good it teaches kids that it is not ok to miss school and it also teaches parents to encourage their kids to go to school or they can get in trouble too.
