Question: What is the maximum penalty for underage drinking?

Answer:

Arizona law (A.R.S. § 8-323) provides for the following penalties for a minor who purchases, possesses, or consumes, spirituous liquor:

 

1. Probation.

2. A juvenile court hearing.

3. Driving privileges suspended for 180 days.

4. Attendance at a counseling or education program.

5. A fine of up to $500.00.

6. Community service work.

7. If truancy is involved, a whole host of programs with parents.

8. With a prior record that indicates delinquency, a whole other host of headaches.

9. A stern talking to by the judge. (Don't laugh, an angry judge is a very scary thing.)

 

It appears that a judge can impose any combination of these things that she thinks is a good idea. Laws in other states are probably similar. The law about juveniles is never cut and dried.

I have just gotten my third underage drinking charge and am desperate to find a way to have it dropped. I cannot afford the fines or losing my liscense. Does anyone know any loopholes or any way to possibly get the charge dropped to a disorderly? Any advice would help.

fight it because i believe there is a something within the law giving the breathalyzers a range of up to .02 of innacuaracy. I had mandatory PBT for 2 months and one day recieved a .02 without drinking because the Breathalyzer wasnt calculated correctly. I would get a lawyer have the Breathalyzer used on you tested and ask to see the date of the last accuracy test before you were givin the PBT. You have a good chance of getting out of it because even zero tolerance allows up to a .02% bac level. Check it out before you go to court

How does the government feel about countries which have no drinking age? Doesn't the fact that we have a drinking age cause many young people to rebel and drink because they are not supposed to. Also, isn't it ridiculous that we can die for our country but cannot be given the full rights of a US citizen? The alchohol legislature is a losing battle because it has not prevented very much at all and has caused more drinking than it has prevented.
