if you have a stalker that sings a song that has words that say they will kill you and rape you, can't you take them to court and charge them of harrasment and assault? maybe even attempted murder?
Assault requires that you would be in fear of imminent bodily harm, like if he were about to hit you. So, unless the person does something like that, assault will probably not come into play. The same goes for attempted murder. The person would have to take some act that would take his actions from merely saying something to actually doing it. For example, if he were to go to your house with a weapon.
