Crack

Possession of crack is a serious offense.  In fact, it is a felony to possess even a small amount of the drug.  Possession of less than 1 gram of crack is punishable by up to 5 years in prison and not less than $5,000 in fines for a first offense.  For a second offense, a person would face a minimum of $10,000 in fines and up to 10 years in prison.  For a third or subsequent offense, a person would face 10 to 15 years in prison and at least $15,000 in fines.  S.C. Code Section 44-53-375(a). 

Possessing 1 gram of crack or more is considered manufacturing, distributing or possession with intent to distribute.  The penalties for this offense are very severe.  A first offense carries a punishment of at least a $25,000 fine and up to 15 years in prison.  A second offense is punishable by a minimum fine of $50,000 and up to 25 years in prison.  A third or subsequent offense carries a minimum of 15 years in prison with a maximum sentence of 30 years and $100,000 in fines.  S.C. Code Section 44-53-370(b).
