    Laws - View Law: FIGHTING AND ASSAULT


    An assault is committed any time a person knowingly causes physical injury to another person. It is also any time that someone may feel physically threatened or when someone touches someone else to provoke or insult them. (A.R.S. § 13-1203).

    Sometimes assault is classified as a misdemeanor. Aggravated assault is a felony. It is important to know this and to realize that fighting can be illegal. If you are involved in a fight, you could also be charged with disorderly conduct or disturbing the peace.

    Fighting and self-defense are sort of a gray area. If you are attacked and defend yourself it is perfectly legal. It gets tricky when there are no witnesses; when the police show up it becomes a he said\she said. If the actual attacker admits to it, then you will not be arrested. If the police can determine who the attacker was by proper questioning, then you are ok. If the police cannot determine who initiated the assault, then you both might go to jail. Be very careful, if you defend yourself to an extreme and do permanent damage, you can be charged under the anti-maiming law.
