When a person drives on a public road in South Carolina, he or she is automatically consenting to a breathalyzer test in the event that a police officer suspects that the driver is intoxicated. S.C. Code Section 56-5-2950.
If a driver refuses to submit to a breathalyzer (or blood or urine) test, his or her driver's license or permit would be suspended. S.C. Code Section 56-5-2951.
