Who has the right to punish me?

Your parents have to right to discipline you. The law gives your parents a lot of room to decide what is an appropriate punishment. This includes corporal punishment (spanking).

While you are at school, teachers and other school officials take the place of your parents.  They have the right to enforce the rules set forth by the school district.  The laws of South Carolina allow school districts to use corporal punishment if the district believes it is necessary.  S.C. Code Section 59-63-260.  And, the U.S. Supreme Court has stated that paddling a student is not cruel and unusual punishment under the 8th Amendment.  Ingraham v. Wright, 430 U.S. 651 (1977).  You can contact your local school district to find out if they allow corporal punishment in your school.

According to South Carolina law, corporal punishment is not unlawful as long as: it is done for the sole purpose of correcting the child; is reasonable; and does not cause "permanent or lasting damage to the child."  S.C. Code Section 20-7-490(2)(a).
