    Question:

    My husband and i were drinking and driving in SC. We were pulled over at a stop light by two officers and we both received a Minor in Posession as well as Open Container in a Motor Vehicle. What kind of fines are we looking at and will this affect our car insurance?



    Answer:

    For the Minor in Possession tickets, the penalties can be a fine between $100 and $200, up to 30 days in jail, or both.  See SC Code 20-7-8920 and 20-7-8925.  For the Open Container tickets, the penalties can be a fine up to $100 or up to 30 days in jail.  See SC Code 61-4-110 and 61-6-4020.  So, the maximum in fines that you and your husband might have to pay is $600.   Also, the Open Container charge is a moving violation and may cause your insurance rates to increase.
