    Smoking and Possessing Tobacco Products 

    Any person who knowingly sells or gives tobacco products to minors is guilty of a petty offense.  Any minor who has tobacco in his or her possession is guilty of an incorrigible act.  (ARS 13-3622). 

    Tobacco products are defined as cigars, cigarettes, or cigarette papers, and smoking or chewing tobacco. (ARS 13-3622) So if you are under the age of 18 you should not have any of these items. If you do, you are guilty of an incorrigible act.

    In addition to this, smoking tobacco in locations such as elevators, busses, libraries, museums, and health care institutions is considered a public nuisance and dangerous to public health.  An adult guilty of such acts would be charged with a petty offense, while a minor would be charged with a delinquent act.  (ARS 36-601.01). 

    What about at school?

    Using or possessing tobacco products on school grounds (buildings, parking lots, fields, and vehicles) or at off campus school sponsored events is a petty offense for adults and a delinquent act for minors.  (ARS 36-798.03).  The law does not apply to adults using tobacco products as a part of a tobacco prevention or cessation program.  (ARS 36-798.03).

    That's because smoking as a teenager (under 18) is illegal. They can't set up specific spot for teenagers to engage in an illegal activity.

    If we cant smoke on school grounds, then why cant the school boards set up an area (OFF CAMPUS!), where we can smoke? I mean thats just stupid! If they dont want US to smoke on school grounds, then let us do it that isn't. I have a school here that have houses right next to it and some of the teachers here smoke, when they get back to their house. Why aren't we allowed to do the same thing? I mean the teachers and staff should at least have a designated area where, we teens who smoke, smoke? I just think that its not right for people to say what we can and can not do. Its our choice!

    personally, i believe in enforcing the law to the maximum degree and i have never been arrested and i have been an honor student from 1st grade to 10th. the only law i break is smoking tobacco, and i believe that a minor should be able to purchase tobacco products at any given time and they should be able to use them at their discretion due to the fact that it makes no difference healthwise on a minor compared to an adult. put it this way, most kids in my area smoke cigarettes and nobody really cares - police officers do not tend to care either. most people start smoking underage, the point is
