    Question: How many breaks at work are required by law?

    Answer: State Laws usually mandate when employers must give you "rest periods" or breaks. How much and when depends mostly on the discretion of the employer, but there are some legal protections.

    There is no federal law that gives you meal or rest breaks. However, states sometimes have labor laws which mandate time off for meals (like a lunch break) or for a rest break (perhaps a mid-afternoon break). Further, labor unions oftentimes have specific contracts that explicitly mandate time for breaks. Whether or not you can get paid during breaks depends on your employer and on the same state labor laws.

    Go to the State of Arizona House of Representatives web-site and read House bill HB2159 article 23-204. There are clear state laws for employers giving employees rest periods and meal breaks. I do not believe and age limitition is applied. See web-site www.azleg.state.az.us or do a search for Arizona meal breaks.

    I feel that the federal government should get involved in making breaks for every 8 hours worked manditory. As of my research now I see that no one state has a set policy on giving breaks it is up to the employer if they want to. This is not fair at all to anyone. If I work 8 1/2 hours I may get a 10 minute break if lucky and if work 12 hrs I may get a 30 minute break if lucky but nothing says that they have to give it so most of the time breaks are not given. Unless we all can get the federal ogvernment to make it manditory that states give braks I think we are just doomed to work.

    I work for a childcare where whenever we are short-staffed we are TOLD we have to work overtime and that we will not have a break. I think it is really unfair that Arizona has no rules regarding breaks for employees. I always thought that every state had rules regarding this matter, but now I will be forced to break the news to my other co-workers that in our state they don't exist. They will not be happy!!!!!!!

    Scott, As a manager for Walgreens you are required to have a 15 minute break after 5 hours of work time per Walgreens policy and procedures. You are also required to be OFFERED a lunch but NOT required to take one. This can be found on your office computer under policies and procedures, the under meal and breaks.
