Question: If I work for commission and I do not make minimum wage do they have to pay me for my time?

Answer: No, If you are employed entirely on a commission basis and your commission does not add up to minimum wage, your employer does not then have to pay you the difference. Basically, commission salary is a roll of the dice. You could make a lot more than minimum wage or a lot less. For instance, many restaurants pay waiters less than the minimum wage because they will make more than that in tips. But if a waiter has a bad week with no tips, he's out of luck. The employer doesn't have to pay him the difference.

I typically tip 20% for good service. However, I don't feel obligated to tip for bad service. I have waiters actually tell me when they present the check that 20% after tax is what I should tip, this from the same waiter who left to refill my drink and never came back till it was time to deliver the check. Tips are gratuity which is exactly what it sounds like, an expression of appreciation for good service. Certainly not something that is "owed"but rather something earned
