Speak Up! - View Question #199

    printer friendly version

Question: If I was fired from work for criminal reasons but I was found not guilty can I sue for back pay and benefits?

Answer: The answer depends on whether you had an employment contract with your boss. If you did, then you would need to hire an experienced employment lawyer to see if the contract protected you from situations like this.

If you did not have an employment contract that protects you, in general, Arizona is a 'right to work' state. This means that your boss can fire you any reason they want, except they can not fire you based on your race, sex, religion, etc. But they can fire you for just about any other reason. They don't even need a good reason, just one that is not discriminatory based on race, sex, etc. So, in Arizona, your boss can fire you if you get arrested or are suspected of a crime, even if you are NOT found guilty later on.
