    printer friendly version

Question: Can an employer fire an employee for bad off the job behavior?

Answer: The answer is both yes and no. An employer usually needs 'cause' to fire an employee. While the things you do outside of work are not usually 'cause' that would lead to your being fired, sometimes things that you do outside of work will affect your performance as an employee. In these cases, an employer may have 'cause' to fire you. As an example, if you are abusing drugs or alcohol so severely that it impacts your performance at work, your employer might try to help you seek treatment and if that fails they might have to let you go. As another example, if your behavior outside of work means that you might pose a danger to your clients or your co-workers, your employer may need to remove you from the workplace to protect them.
