    Question: If i was hanging out in a park at 9 55 and a cop showed up and gave us a curfew ticket is that right? a cell phone is satellite time is there any way to fight it

    Answer:

    The Phoenix City Code's curfew doesn't mean only the time at night you are allowed out, but the time you are supposed to be home. The activities of children under the age of 18 is regulated at night by City Code 22-1 and 22-2. Youths, age 15 and under must be home between 10 PM and 5 AM and those 16 and 17 years of age must be home between midnight and 5 AM. This means that you are not allowed to be out in public until 9:59:59 pm, but that you must be in your home at 10 pm. If you are at a park at 9:55, then it is reasonable for the officer to cite you for violation of curfew because you are not able to be at home by the curfew time.

    "a cell phone is satellite time" Firstly, a standard cellular phone has nothing to do with satellites, you might be thinking of, instead, it synchronizing with a nuclear clock linked to through the network. Secondly, the officer has no way of knowing where you live. You could live across the street, 1 minutes walking distance away. I don't know what the law is in AZ, but here, most parks are closed at sunset. I find it more likely you were just at the park after closing and therby trespassing.
