    Question:

    I was walking home with 6 friends drunk at 4 am and we were stopped by police. They asked us who had been drinking and the 3 of the 5 who had been drinking were breathalized and arrested, the other two lied and got away with it. We were charged with underage with alcohol in body [ARS 4-244(40)]. We have a court date but do not know whether we need lawyers/what the likely punishment is, any help would be appreciated.



    Answer:

    First we can not advise you if you should get an attorney, you need to discuss this with your parents. The penalty for A.R.S. § 4-244(40) is a class 2 misdemeanor. Depending on past criminal charges and your school attendance record,  the penalty could be a diversion program, and possibly community service or a fine. Ultimately the punishment can depend on your specific situation.

    You'll be straight man. It's just a misdemeanor. You'll get a fine or community service. Just be smart enough not to do it again. If your gonna drink stay home. If your under 21 dont drink at all. Take it from me, I've been arrested several times as an ignorant youngster. None of it is worth it.
