    printer friendly version

Question: Can they put a juvenile who is mentally ill in prison?

Answer: After being tested by doctors, a mentally ill person who is accused of a crime (delinquent act) will be found to be competent, incompetent but restorable, or incompetent and not restorable. A person that is incompetent and not restorable cannot be prosecuted and locked up in juvenile court but is sometimes ordered to live in a mental hospital. If the juvenile is tried in adult court, they might be found guilty but insane and would be sent to a mental hospital instead of to prison.

Hospitals are being overflown with people who are mentally Ill, finally when they are turned down from every other place they live out on the streets. So they should get treatment from the hospitals but not have to stay there. But live in a safe inviroment where they can be watched so they dont get into any trouble.

I think that a person who is mentally ill should go to a hospital, not prison! It isn't always that persons fault when they do something. Some people just don't know where to turn for help. Other people should be willing to help them.
