    printer friendly version

Question: I have been given a ticket on indecent exposure for masturbating in a parking lot inside my car. Would you please let me know what could be the fine and punishments?.

    Answer:

Indecent exposure is complicated. It usually is a class 1 misdemeanor. However, if the victim is under the age of 15, the offense is a class 6 felony (ARS 13-1402). Juvenile sentencing range is the same as above. For adults, it can result in jail terms of up to 6 months, and fines up to $2,500 plus an 80% surcharge. In juvenile court, punishment can be anything from a fine, to probation (with detention time, etc.), to imprisonment until the defendant reaches the age of 18.  On a felony conviction, the person may get probation but could instead be ordered to serve prison time of from .33 to 2 years in the state Department of Corrections. Fines for felonies can be up to $150,000 plus an 80% surcharge. More seriously, if a person is found to have committed such an offense for a second time, he or she may face lifetime registration as a sex offender (ARS 13-3821).

The real question is exacly why were you masturbating in a car in a parking lot? You should proby keep that sort of activity at YOUR house in YOUR room. Thats just my opinion.
