Question: Where can I find the laws against Child Porn for my state along with federal laws. What are the consequences (fines, jail time, etc.) against down loading it vs. possessing it.
Answer: A good resource for researching the law is www.findlaw.com. At that site you can click on 'Laws:Cases and Codes' and then either 'US Code' for federal law or 'States' for state law. Then enter 'pornography' into the search engine. In the 'US Code' database the search will return federal laws on pornography as well as the decisions of judges, including the United States Supreme Court, in cases involving pornography. In the 'States' database your search will return state law on pornography.
In Arizona you can be convicted of a class 5 felony if you print, copy, manufacture, prepare, produce or reproduce obscene items (ARS §13-3502). You could be convicted of a class 4 felony if you recklessly transmit, furnish, present, provide, make available, give, lend, show, advertise, offer or distribute to minors obscene items. Punishment for a class 4 felony is imprisonment for a year and a half to three years. Punishment for a class five felony is imprisonment for nine months to two years. Either conviction can also include a fine of up to $150,000.
